This Criminal Original Petition has been filed to direct the first and second respondents to provide adequate Police protection to the petitioner for his life, limb and property in Survey No.58/4 situated at T.Vairavanpatti Group, Thaniyanendhal, Tirupathur Taluk, Sivagangai District, measuring about 75 cents by considering the petitioner's representation dated 21.06.2022.
2. The facts of the case are that there was a dispute between the petitioner and the third respondent in respect of the land, in Survey No.58/4, situated at T.Vairavanpatti Group, Thaniyanendhal, Tirupathur Taluk, Sivagangai District, measuring about 75 cents, which was purchased by the petitioner from the third respondent through registered sale deed vide Document No.215 of 2020. From the date of purchase, the petitioner is in absolute possession and enjoyment of the aforesaid land. The third respondent with an ill intention, to grab the land from the petitioner, preferred a false complaint against the petitioner. Based on the complaint, without proper enquiry, an F.I.R in Crime No.04 of 2022 dated 28.02.2022 was registered. Aggrieved over the same, the petitioner filed Crl.O.P.(MD).No.10496 of 2022 to quash the F.I.R. This Court vide order dated 14.06.2022 granted an order of interim stay. In such circumstances, the third respondent illegally trespassed into the petitioner's land and caused 2/4
damages to his property. Being a disabled person and having no other way, the petitioner preferred a detailed representation dated 21.06.2022 to provide Police protection. Since no action was taken, the present Criminal Original Petition has been filed.
3. The learned Government Advocate (Criminal Side) appearing for the respondent Police submitted that the respondent Police received the representation of the petitioner and soon it will be considered.
4. Recording the same, this Court directs the respondent Police to provide sufficient protection by considering the petitioner's representation dated 21.06.2022 and take action on merits as expeditiously as possible.
5. With the above direction, this Criminal Original Petition is disposed of.
