ORDER

The present petition has been filed by accused No.4 in C.C.No.135 of 2022 on the file of the District Munsif Cum Judicial Magistrate Court, Athoor seeking to quash the charge sheet wherein he charged with the offence under Sections 294(b), 323 and 324 of I.P.C.

2.A perusal of the charge sheet reveals that the petitioner along with other accused are said to have attacked the defacto complainant who is injured and treated as an in-patient.

3.According to the learned counsel appearing for the petitioner, the petitioner is no way connected with the said incident and he has been falsely implicated in this case.

4.Heard both sides and perused the material records. 5.A perusal of the charge sheet reveals that specific overtact has been alleged as against the petitioner and he is said to have attacked the defacto complainant and caused injuries. In such circumstances, no legal ground has been made out for quashing of the charge sheet. 6.The presence of the petitioner before the trial Court shall be dispensed with unless specifically directed by the trial Court. The trial Court is directed to dispose of the above said case without being influenced by any one of the observations made by this Court.

7.With the above said observations, this Criminal Original Petition stands dismissed. Consequently, connected miscellaneous petitions are closed.
