Today (27.01.2026), the matter is posted under the caption 'for being mentioned' at the instance of the learned counsel for the petitioner.

2. Learned counsel for the petitioner submitted that this Court had dispensed with the personal appearance of all the petitioners before the Trial Court. But in the order copy dated 12.01.2026, in paragraph No.4, the second petitioner was not mentioned for the relief.

3. In view of the submission made by the learned counsel for the petitioner, the 3rd and 4th paragraph of the order dated 12.01.2026 is replaced as follows:

" 3. Considering the facts and circumstances, the personal appearance of the petitioners before the learned Trial Court is ordered to be dispensed with, on condition that they shall appear at the time of initial questioning, proceedings under Section 313 Cr.P.C., / 351 BNSS, and at the time of passing judgment and on all the specifically directed by the learned Trial Court.

If the petitioners adopt any dilatory tactics, it is open to the learned Trial Court to insist for their appearance and deal with the petitioners in accordance with the law laid down by the Hon'ble Supreme Court of India, in the case of State of UP Vs Shambunath Singh".

4. Registry is directed to carry out the correction and issue fresh order copy to the parties concerned.
