PRAYER: Petition under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the respondents to refund the sale consideration amount paid by the petitioner on E-auction pertaining to purchase of Plot No.97, Plot No.133 and Plot No.134 situated in Uthamapandiankulam Village, Tirunelveli District with nominal interest within a time frame fixed by this Court.

ORDER

[Order of the Court was made by The Hon'ble CHIEF JUSTICE] We have heard Mr.R.J.Karthick, learned counsel for the petitioner and Mr.N.Dilip Kumar, learned Standing Counsel for the bank.

2. The learned counsel for the petitioner submits that the petitioner has paid the entire consideration amount of the properties in December, 2020. The Sale Certificates are also issued in favour of the petitioner on 21.04.2021. But, the same has not yet been registered. The respondent bank may be directed either to register the Sale Certificate or to refund the amount.

3. The learned Standing Counsel for the bank submits that the bank is ready to cooperate with the petitioner and register the Sale Certificates on given date.

4. It is agreed that the parties would remain present before the concerned Sub-Registrar on 07.09.2023 at 11.00 a.m.

5. The parties may take steps to register the Sale Certificates in accordance with law.

6. With the above observations, the writ petition is disposed of. No Costs.
