Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the first respondent to direct the third respondent to initiate appropriate action against the Katta Panchayat Gang / respondents 4 to 11, according to law and subsequently, direct the third respondent to give protection to the petitioner, based on his representation, dated 27.07.2017, within a stipulated time limit.

O R D E R

This Writ Petition has been filed seeking a direction to the first respondent to initiate appropriate action against the Katta Panchayat Gang / the respondents 4 to 11, in accordance with law.

2. The grievance of the petitioner is that the petitioner is working as an employee in the fourth respondent Chicken Shop and there was a loss when the petitioner was an employee, for which the respondents 5 to 11 conducted Kangaru Court and asked the petitioner to make payment of the loss and also harassing him to pay a sum of Rs.9,85,000/-. In the above circumstances, he made a representation to the respondents 1 to 3 to take action against the respondents 4 to 11 for conducting Kangaru Court. Since no action has been taken, the present writ petition has been filed.

The learned Additional Public Prosecutor on instructions would submit that the petitioner's complaint has been enquired into and the third respondent Inspector of Police found that a civil dispute is pending between the parties and there is no Katta Panchayat as alleged by the petitioner. That apart, now the petitioner himself is residing in some other place.

4. Recording the above said submission, the writ petition is closed as there is no material available to conduct the Kangaru Court. However, if the respondents 5 to 11 made further harassment, it is always open to the petitioner to approach the concerned authority to seek appropriate remedy, in the manner known to law. Accordingly, the writ petition is dismissed. No costs.
