PRAYER: Criminal Original Petition is filed under Section 528 of BNSS, 2023, to pass an order of direction to direct the respondents 1 and 2 to provide adequate police protection to the petitioner and her family members for re-erecting the damaged stone fence in the property comprised in Survey No.92/3 and its sub-divisions Survey Nos.92/3B and 92/5E2 situated at Kudakottai Village, Keelakarai Taluk, Ramanathapuram District at the petitioner's own cost based on the petitioner's representation dated 16.06.2026 and pass such other orders as this Court may deem fit. ORDER

The present petition has been filed seeking adequate police protection to the petitioner and her family members for re-erecting the damaged stone fence in the property comprised in Survey No.92/3 and its sub-divisions Survey Nos.92/3B and 92/5E2 situated at Kudakottai Village, Keelakarai Taluk, Ramanathapuram District.

The learned counsel appearing for the private respondents brought to the notice of this Court that the petitioner herein had already filed a suit in O.S.No.226 of 2025, before the Sub Court, Ramanathapuram seeking permanent injunction for the same property and so far interim orders have not been granted. In such circumstances, the present prayer cannot be granted for putting up the fence.

3. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the private respondents.

4. In view of the fact that civil suit is pending between the parties with regard to the above said survey numbers, this Court is not inclined to pass any order providing police protection to the petitioner for re-erecting the damaged stone fence in the disputed property.

5. It is always open to the petitioner to approach the concerned civil Court seeking interim orders. With the above said observation, this Criminal Original Petition stands disposed of.
