PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.175 of 2021 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioners apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 148, 294(b), 448, 352, 427 and 506(ii) of IPC in Crime No.175 of 2021 on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that due to election dispute between the parties, all the accused have attacked the de-facto complainant with iron rod, wooden log, aruval and knife and also trespassed into his house and ransacked three two-wheelers, cell phone and other household articles. Hence, the case. 3.The learned counsel for the petitioners submitted that the petitioners are innocents and they have not committed any offence as alleged by the prosecution, but they have been falsely implicated in this case.
4.The learned Government Advocate (Crl.Side) appearing for the respondent police, on instructions, would submit that the injured was treated as out-patient.
5.The learned counsel for the de-facto complainant strongly opposed the grant of anticipatory bail on the ground that the vehicles have been damaged by the petitioners and he has also placed photographs before this Court, which shows that the vehicles and other articles were damaged.

The learned counsel for the petitioners submits that in order to show their bonafide, the petitioners are ready to deposit a sum of Rs.2,000/- each to the credit of Crime No.175 of 2021 before the learned Judicial Magistrate, Thiruvidaimaruthur. 7.Considering the facts and circumstances of the case, the nature of allegation levelled against the petitioners and the fact that the petitioners offered to deposit a sum of Rs.2,000/- each to the credit of Crime No.175 of 2021, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. 8.
Accordingly, this Criminal Original Petition is allowed and the petitioners are ordered to be released on bail in the event of arrest or their appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate, Thiruvidaimaruthur, on condition that the petitioner shall execute a bond for a sum of Rs.
[b]the petitioners are directed to deposit a sum of Rs.2,000/- (Rupees Two Thousand only) each to the credit of Crime No.175 of 2021 before the learned Judicial Magistrate, Thiruvidaimaruthur, within a period of two weeks without prejudice to their rights and contentions before the trial Court;

[c] the petitioners shall report before the respondent police daily at 10.30 a.m., until further orders;
[d]the petitioners shall not tamper with evidence or witness either during investigation or trial;
[e]the petitioners shall not abscond either during investigation or trial;
[f] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]; [g] If the accused/petitioners thereafter absconds, a fresh FIR can be registered under Section 229A IPC.
