ORDER
(Order of the Court was made by N.SATHISH KUMAR, J.) The writ petition has been filed seeking the issuance of a writ of mandamus directing Respondents 1 to 5 to develop and maintain the Children's Park in the land earmarked as a park in the Tamil Nadu Housing Board Colony, Konam, comprised in Survey Nos. 23/3 and 24/3, situated at Konam, Agastheeswaram 2/6
Taluk, Nagercoil, Kanyakumari District, within a time frame to be stipulated by this Court.
2.The fifth respondent has filed a status report stating that the subject land is earmarked for a park. It is further stated that the estimated cost for the development of the Children's Park would exceed Rs.30,00,000/-. Such expenditure cannot be met from the ordinary General Fund available with the fifth respondent Corporation. Since the proposed work is a capital infrastructure project and not a routine maintenance activity, it requires separate administrative and financial sanction from the competent authority.

The learned Standing Counsel appearing for the fifth respondent submitted that the fifth respondent would forward the proposal along with a Detailed Project Report (DPR) for the establishment of the Children's Park to the first respondent. Upon obtaining the necessary financial sanction from the first respondent, the fifth respondent would take immediate steps for the implementation of the project and establishment of the Children's Park. 3/6
4. Recording the submission made by the learned Standing Counsel appearing for the fifth respondent, no further orders are required in this matter. The fifth respondent shall forward the necessary proposal along with the Detailed Project Report to the first respondent within a period of three months from the date of receipt of a copy of this order. Upon receipt of the said proposal, the first respondent shall ensure that the necessary administrative and financial sanctions are accorded within a period of six months thereafter.
5. With the above directions, this writ petition stands disposed of. There shall be no order as to costs.
