Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent herein to dispose of the petition preferred by the petitioner dated 21.09.2020 under Section 145 of Cr.P.C., seeking action against the 4th and 5th respondents within a time frame stipulated by this Court. O R D E R

Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents 1 to 3. 2.The petitioner alleges that his pipe lines are being damaged by the private respondents herein. The petitioner has given a complaint in this regard.

3.The learned Government Advocate states that the petitioner has given a statement that he does not want to pursue the matter. I declined to believe the said version. When the petitioner has come to this Court for taking action under Section 145 of Cr.P.C., it is not believable that the petitioner would have told the local police that he wants to withdraw the complaint. W.P.(MD)No.14324 of 2020 directed to take appropriate action on the petitioner's complaint. If the petitioner's complaint makes out cognizable offence, then FIR shall be registered. If no cognizable offence is made out, the petition enquiry shall be concluded within a period of two weeks from the date of receipt of a copy of this order. The petitioner shall be informed the outcome of the enquiry so that the petitioner can take further action in accordance with law. 4.The writ petition is disposed of on these terms. No costs.
