PRAYER :- For Bail in Crime No.116 of 2023 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/A3 who was arrested and remanded to judicial custody on 03.04.2023 for the offences punishable under Sections 147, 148 and 302 of IPC in Crime No.116 of 2023 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the de-facto complainant's younger son and Dhanalakshi w/o Chandran are having illegal intimacy for the last three years. Due to that, one Samuvel, who is the elder sister's son of Dhanalakshmi warned the deceased. Further, on 03.04.2023 at about 04.00 p.m., when the deceased was working at Abi Sampirani Company, Hussain Colony, Sivakasi, the petitioner and other accused went there and attacked the deceased with sickles and thereby caused death to him. 3.Heard. Perused the materials available on record including the First Information Report.

CRL OP(MD). No.9775 of 2023 4.It is seen that there are five accused involved in this case, in which, the petitioner is arrayed as A3. The first accused mother's sister had illegal intimacy with the deceased. Therefore, the first accused engaged the other accused persons in order to do away the life of the deceased. During day light, the petitioner along with other accused persons attacked the deceased with deadly weapons. Due to which, he sustained 24 cut injuries in his all over body. That apart, now the respondent police had sent proposal for detaining the petitioner under the Goondas Act. 5.Taking note of the seriousness and gravity of the offence, this court is not inclined to grant bail to the petitioner. 6.In the result, the petition stands dismissed. sd/- 06/06/2023 / TRUE COPY / /06/2023 Sub-Assistant Registrar (C.S.)
