ORDER

The present Transfer Civil Miscellaneous Petition has been filed to withdraw the HMOP.No.121 of 2024 on the file of Principal Sub Court, Thiruchengodu and transfer the same to the Sub Court at Karur District.

2. The petitioner is the husband and the respondent is the wife. The marriage between the petitioner and the respondent was solemnized on 24.04.2021 at Namakkal, as per the Hindu Rites and Customs. During their wedlock, one male child, was born on 24.04.2021.

3. Due to some matrimonial discord, the parties have separated. Therefore, the petitioner/husband initiated a proceeding in H.M.O.P.No.649 of 2023, before the Family Court, Karur, seeking divorce. Thereafter, it was transferred to the file of Sub Court, Thiruchngodu by way of filing of Tr.CMP(MD)No.140 of 2024 by the respondent/wife and it was renumbered as HMOP.No.121 of 2024.

The learnt counsel appearing for the petitioner/husband made an allegation against the respondent/wife that there is a life threat at the hands of the respondent/wife while attending the court proceedings in HMOP.No.121 of 2024 on the file of the Principal Sub Court, Thiruchengodu. Hence, he seeks to allow this petition as prayed for.

5. Heard the learned counsel appearing for the petitioner and perused the materials available on records.

6. This Court finds no merit in the petition regarding the allegation made by the petitioner/husband that there is life thereat since no material was adduced before this Court to substantiate the same. Hence, the petition is liable to be dismissed.

7. Accordingly, the Transfer Civil Miscellaneous Petition stands dismissed. There shall be no order as to costs. Consequently, the connected Civil Miscellaneous Petition is closed.

8. However, the learned Principal Sub Judge, Thiruchengodu, is directed to dispose of the case in HMOP.No.121 of 2024 as expeditiously as possible in accordance with law.
