PRAYER:- Petition - filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to conduct an enquiry and to pass orders in the appeal preferred by the petitioner pending on the file of the 1st respondent.

ORDER

When the matter came up for hearing on 04.10.2023, this Court passed the following order:- "The learned Special Government Pleader for the first respondent seeks time to take instructions in this case, pursuant to the earlier order dated 16.12.2020.

2. Post this Writ Petition on 12.10.2023. In the meantime, the learned Special Government Pleader shall also ascertain if the petitioner has already expired during the pendency of this Writ Petition."

2. When the matter was taken up for hearing today, the learned counsel for the petitioner submitted that the petitioner has died during the pendency of this writ petition and that there was no response from the legal heirs of the deceased petitioner.

3. Recording the same, this writ petition is dismissed as abated. No costs.
