PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, forbearing the third respondent herein, his men, agents or anybody from allotting the retail outlet dealership of Indian Oil Corporation to the fourth respondent at Ayyampalayam to Sitharevu Road, Sitharevu Village, Athoor Taluk, Dindigul District. ORDER
The prayer in this writ petition is forbearing the third respondent and his men from allotting a retail outlet dealership of Indian Oil Corporation to the fourth respondent at Ayyampalayam to Sitharevu Road, Sitharevu Village in Athoor Taluk, Dindigul District.

Pleader for the first respondent, Mr.K.Muraleedharan, learned counsel for the third respondent and Mr.M.Saravanan, learned counsel for the fourth respondent.
3. Mr.M.Saravanan, learned counsel for the fourth respondent, would submit that the petitioner is a licensee of Bharath Petroleum Corporation and he is having a retail outlet at Sitharevu Village, where as the third respondent has issued a letter of intent to the fourth respondent to establish a petrol bunk at Ayyampalayam, which is 4 km away from Sitharevu Village.
4. In view of the above submission, this Court is of the opinion that the petitioner is not entitled for the relief sought for in this writ petition. Hence, this writ petition is dismissed. No costs. Consequently, the connected Miscellaneous Petition is dismissed.
