PRAYER :- For Bail in Crime No.115 of 2023 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Sole Accused who was arrested and remanded to judicial custody on 15.05.2023 for the offences punishable under Sections 436 and 506(ii) IPC in Crime No.115 of 2023 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that due to wordy quarrel between the petitioner's sister family and the de-facto complainant's parents, on 07.05.2023 at 10.30 p.m., the petitioner had quarrelled with the de-facto complainant and set on fire with her house. Hence, the case.
3.Heard. Perused the materials available on record including the First Information Report.
4.It is seen that the petitioner had living together relationship with the de-facto complainant. There was a dispute 1/3
between them and as such, the petitioner caused fire by pouring petrol on the house of the de-facto complainant. 5.Taking into consideration of the facts and submissions made by the learned counsels, this court is inclined to grant bail to the petitioner subject to the following conditions: [a] Accordingly, the petitioner shall pay a sum of Rs.20,000/- (Rupees Twenty Thousand only) to the credit of Crime No.115 of 2023 before the learned Judicial Magistrate Court, Periyakulam, without prejudice to his rights and contentions.
[b] On such deposit being made, the petitioner is ordered to be released on bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate Court, Periyakulam, and on further conditions that: [c] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity. [d] the petitioner shall report before the respondent police daily at 10.30 A.M., for a period of four weeks and thereafter, report before the respondent police as and when required for interrogation;
[e] the petitioner shall not commit any offences of similar nature.
[f] the petitioner shall not abscond either during investigation or trial.
[g] the petitioner shall not tamper with evidence or witness either during investigation or trial.
[h] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
[i] If the accused thereafter absconds, a fresh FIR can be registered under Section 229A IPC.
