ORDER : The Court Made the following order :- The petitioner is remanded to judicial custody in Crime No.147 of 2018 on the file of the respondent police for the offences punishable under Sections 366(A) of IPC r/w 6, 5(1) of the Protection of Children from Sexual Offences Act, 2012 and he seeks bail.
2. The case of the prosecution is arising out of love affair. The petitioner herein and the de facto complainant's daughter, who is aged 17 years, fell in love. Since the parents of the victim girl made arrangements for her marriage, the victim girl escaped from the custody of the de facto complainant and eloped with the petitioner.
3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate [Criminal Side] for the respondent State.
4. According to the petitioner, the victim girl went along with the petitioner due to love affair and it is further submitted that the petitioner is an innocent and a false case has been foisted against him.
5. The learned Government Advocate [Criminal Side] opposed the grant of bail by stating that the investigation is not yet over.
6. Considering the facts and circumstances of the case and also taking into consideration of the relationship between the petitioner and the de facto complainant, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail subject to the following conditions: (i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Sessions Judge, Fast Track Mahila Court, Ramanathapuram and (ii) the petitioner shall appear before the respondent police daily at 10:30 a.m. until further orders.
