PETITIONER/PETITIONER Vs STATE REP BY THE INSPECTOR OF POLICE AYYAMPETTAI POLICE STATION, THANJAVUR DISTRICT CRIME NO. 1206 OF 2020) ... RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to extend the time limit granted by this Hon`ble Court with regard to the execution of sureties in Crl.O.P. (MD) No. 8818 of 2020 dated. 24.08.2020.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.PITCHAIMUTHU.M, Advocate for the petitioner and of MR.P.KOTTAI CHAMY on behalf of the Respondent the court made the following order:- This petition has been filed to extend the time granted by this Court in Crl.O.P.(MD)No.8818 of 2020 dated 24.08.2020, for executing the sureties.

2. The learned counsel for the petitioner submits that the petitioner was granted anticipatory bail by this Court in Crl.O.P. (MD)No.8818 of 2020, on 24.08.2020 with a condition that the petitioner shall pay a sum of Rs.5,000/- to Seva Chakkara Orphanage and on further conditions that the petitioner shall appear before the concerned Magistrate and furnish the sureties within 15 days. As per the order of this Court, the petitioner, on 14.09.2020, paid the amount as mentioned above. Thereafter, since his wife is a mentally challenged person, he has to take care of his wife and therefore, he could not appear before the concerned Magistrate and execute the sureties in time. Further, it is submitted that the petition for extension of time filed before this Court in SR No.14522 of 2021 is found missing. Therefore, the petitioner has come forward with this petition.

3. It is seen that the petitioner was granted anticipatory bail on 24.08.2020. But, the petitioner, after the lapse of one year, has filed this petition for extension of time. Further, in the supporting affidavit, there are no valid reasons assigned by the petitioner for non-execution of sureties in time and the delay in filing the petition. Therefore, this Court is not inclined to entertain this petition. Accordingly, the Criminal Miscellaneous Petition is dismissed.
