ORDER : The Court made the following order :- The respondent police registered a case as against the petitioner in Crime No.105 of 2024 for the offence under Section 6(4) of Tamil Nadu Scheduled Commodities (RDCS) Order 1982 r/w. Section 7(1)(a)(ii) of Essential Commodities Act, 1955. Therefore, the petitioner has filed this petition seeking anticipatory bail. 1/3

2. The case of the prosecution is that the petitioner and other accused have illegally transported 3000 Kgs of PDS rice from Tamil Nadu to Kerala.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent strongly opposes to grant bail on the ground that the investigation is pending.

5. Considering the quantity involved and since the seized rice is meant for public distribution, this Court is not inclined to grant anticipatory bail to the petitioner.
