: Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the order of suspension passed in Na.Ka.No.A1/7023/2019 by the 2nd respondent dated 05.08.2021 and quash the same as illegal and further direct the 2nd respondent to reinstate the petitioner into service. O R D E R
The order of suspension, dated 05.08.2021, is under challenge in the present writ petition.
2.The petitioner was working as Village Administrative Officer and there was a complaint against the petitioner regarding the sexual harassment and Internal Complaints Committee has been constituted, who in-turn conducted an enquiry into the provision of the sexual harassment and based on the report, the petitioner was placed under suspension.
3.The order of suspension reveals that the women employees have given a complaint against the writ petitioner and based on their complaint, the Competent Committee was appointed and accordingly, https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P(MD)No.14326 of 2021 the Committee gone into the allegations and filed a report and thereafter, the petitioner was placed under suspension. 4.This being the factum, this Court do not find any acceptable grounds for the purpose of interfering with the order of suspension. 5.The learned Additional Government Pleader appearing on behalf of the respondents made a submission that the enquiry of disciplinary proceedings are in progress and only after completion of enquiry, all further actions are to be taken in this regard. 6.In view of the fact that the allegations are serious in nature, this Court is of the opinion that the petitioner has to face the enquiry and defend his case in the manner known to law. Therefore, there is no reason to interfere with the impugned order of suspension at this point of time and accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
