ORDER
(Order of the Court was made by P.VELMURUGAN, J.) This Habeas Corpus Petition is filed seeking a direction to the respondents 1 and 2 to produce the body or person of detenue by name Sangeetha L, D/o.Leela Ram, aged about 18 years, who has been illegally detained by Pravin Kumar and Kamlesh Choudhary and produce her before this Court and hand over her custody to the petitioner.
2. The learned counsel appearing for the petitioner would submit that the third respondent is already a married person and therefore, this Court may issue a direction to the respondents 1 and 2 to produce the detenue before this Court.
3. The learned Additional Public Prosecutor appearing for respondents 1 and 2 would submit that the detenue had gone to Ludhiana and had also obtained an order from the Court of Session, Ludhiana, 2/6
dated 20.03.2026. He would further submit that she has also married one Praveen Kumar. In support of the said submission, he has produced the order of the learned Sessions Judge, Ludhiana, dated 20.03.2026.
4. The order of the learned Sessions Judge, Ludhiana, dated 20.03.2026, is extracted hereunder:
"CNR No. PBLD010066022026 SANGEETHA L-PRAVIN KUMAR VS. STATE OF PUNJAB & ORS.
Present: Petitioners along with counsel Sh. Vikrant Nathar, Advocate This protection petition presented before me being Incharge. Sessions Judge. Ludhiana as learned Sessions Judge is on short leave. It be registered.
Heard. Statements of petitioners have been recorded separately. Statement of Manoj Dhiman, son of Rajpal Dhiman has also been recorded separately in whose house both the petitioners are residing From the statements suffered by the petitioners, it becomes evident that they have solemnized marriage with each other against the wishes of private respondent Nos.3 to 6 and there is imminent threat to their lives. Therefore, there are sufficient grounds to grant interim protection to the petitioners. As such, interim protection is hereby granted to the petitioners in accordance 3/6
with directions given by Hon'ble Punjah & Haryana High Court in case titled Asha & Ant. Versus State of Haryana in CWP No 6717 of 2009.
Respondent No.2 i.e., SHO of P.S. Model Fown. Ludhiana is directed to protect the life and liberty of the petitioners at the hands of private respondents strictly in accordance with law. It is clantied that this order shall not be treated as a stamp of the Court regarding validity of marriage of the petitioners or as proof of their date of birth. It is observed that in case petitioners have committed any offence, then police shall be at liberty to proceed against them in accordance with law.
File be put up before the learned Sessions Judge. Ludhiana on 23.03.2026 for further proceedings. Petitioners are directed to appear on the said date."
5. In view of the above, since the detenue has attained majority and has also obtained an order from the learned Sessions Judge, Ludhiana, dated 20.03.2026, no further orders are required to be passed in this Habeas Corpus Petition.
