ORDER:- This Criminal Miscellaneous Petition is coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.S.Jeyasingh, Advocate for the Petitioner, this Court made the following order:

The criminal appeal is arising out of the judgment acquitting the accused in the complaint filed against him under Section 138 of the Negotiable Instruments Act.

2.This Court has entertained this appeal and issued notice to the respondent. The notice sent to the respondent was returned as 'refused'. Therefore, the petitioner has filed this petition to issue a non-bailable warrant of arrest as against the respondent.

3.Since the respondent has refused to receive the notice, this petition is allowed. The Registry is directed to issue non-bailable warrant of arrest as against the respondent, through trial Court.
