ORDER
This Criminal Original Petition has been filed for issuing a direction to the 3rd respondent police and his subordinates not to harass the petitioner under the guise of enquiry in connection with a partnership dispute at the instance of the 4th respondent.
2. The learned counsel appearing for the petitioner submitted that the petitioner and the fourth respondent herein are partners. Because of some issues between them, the 4th respondent by giving complaints pressurizing the petitioner to settle the entire amount involved in the partnership business.
3. The learned Additional Public Prosecutor would submit that based on the complaint given by the 4th respondent enquiry was conducted and during the course of enquiry, both parties appeared and 2/5
reached understanding that the amount will be settled within the time stipulated, failing which, he will obey the action to be taken by the complainant. Hence, the complaint was closed. Per contra, the learned counsel appearing for the petitioner submitted that the above said undertaking was obtained by force.
4. Since the complaint has been closed, nothing survives for consideration in this petition. The parties shall work out the remedy through appropriate proceedings in the manner known to law.
5. With the above observation, this Criminal Original Petition is disposed of.
