To Suspend the sentence imposed on the petitioner by the learned I Additional District and Sessions Judge, Thoothukudi, Thoothukudi District, in S.C.No.121 of 2020 by the judgment dated 09.03.2026 and enlarge the petitioner on bail pending disposal of the appeal.

ORDER

(Order of the Court was made by the Hon'ble N.Anand Venkatesh J.) This petition has been filed seeking suspension of the sentence of imprisonment imposed on the petitioner by the learned I Additional District and Sessions Judge, Thoothukudi, Thoothukudi District, in S.C.No.121 of 2020, by

judgment dated 09.03.2026 and to enlarge the petitioner on bail.

2. The case of the prosecution is that the deceased, Harikumar, is the son-inlaw of A1 and PW1. The deceased and the daughter of A1 got married. It is alleged that the deceased used to harass his wife and subject her to cruelty. On 21.06.2018, the deceased was quarrelling with his wife (PW5) and as a result, PW5 fainted. A1, who is the father, was not able to tolerate the conduct of the deceased and is said to have attacked him with a wooden log lying nearby on the head. A2, who is also another son-in-law, is said to have attacked the deceased with a wooden log and the deceased succumbed to the injuries. It is under these circumstances that the accused persons underwent trial before the I Additional District and Sessions Court, Thoothukudi.

The Trial Court, on considering the facts and circumstances of the case and on appreciation of the oral and documentary evidence, came to the conclusion that the prosecution has proved the case beyond reasonable doubt against the petitioner (A1) and accordingly convicted and sentenced the petitioner in the following manner:

Provision under which Sentence convicted Sec.302 of IPC Life Imprisonment and to pay a fine of Rs.

10,000/-, in default to undergo three months Simple Imprisonment.

Section 203 of IPC Two years Rigorous Imprisonment.

4. The above sentences were ordered to run concurrently. Aggrieved by the same, an appeal has been filed along with this petition.

5. The Trial Court acquitted the second accused of all charges.

6. Heard the learned counsel for the petitioner and the learned Counsel for the State of Tamil Nadu (Crl. Side) appearing for the respondent.

Taking into consideration the facts and circumstances of the case and considering the manner, in which the entire incident had taken place and taking note of the fact that PW5 did not support the case of the prosecution and also taking into consideration the fact that the petitioner has been undergoing incarceration since March 2026 and that there are no previous cases against the petitioner, this Court finds that there are arguable points in the present appeal and that it will take some more time for this Court to take up the appeal for final hearing. Hence, this Court is inclined to grant suspension of sentence by suspending the sentence imposed on the petitioner. Accordingly, this petition is allowed subject to the following conditions: i. The petitioner is directed to be enlarged on bail on executing a bond for Rs.10,000/- (Rupees Ten thousand only) with two sureties, each for a like sum to the satisfaction of the learned I Additional District and Sessions Judge, Thoothukudi, Thoothukudi District.

ii. The sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Trial Court may obtain a copy of their Aadhar card or Bank passbook to ensure their identity.

iii. The petitioner shall appear and sign before the trial Court at 10.30 a.m., on the first working day of every English calender month, till the disposal of the Criminal Appeal.
