JUDGMENT

************** [Judgment of the Court was delivered by R.SURESH KUMAR, J.] This Writ Appeal has been directed against the order passed by the Writ Court in W.P.(MD)No.7146 of 2022 dated 05.08.2022.

2.A similar order had been passed in many number of cases by the Writ Court as that of the present impugned order. Against one such order, Writ Appeal in W.A.(MD)No.310 of 2023 was filed by the State and that was dismissed by a Division Bench of this Court on 27.03.2023. As against the same, the State filed S.L.P. (Civil) No.13168 of 2023 and the said SLP also was dismissed.

3.Following the same, when yet another Writ Appeal in W.A(MD)No.32 of 2024, on similar line had been filed by the State, the Division Bench, taking note of the aforesaid fact by order dated 12.01.2024, dismissed the said Writ Appeal in the following lines: "Mr.S.P.Maharajan, learned Special Government Pleader appearing for the State has submitted before this Court that in a similar matter, the Government has filed an appeal in W.A.(MD)No.310 of 2023. This Court by an order dated 27.03.2023 had dismissed the said appeal.

The said dismissal order was challenged before the Hon'ble Supreme Court in SLP (Civil) No.13168 of 2023 and the same was also dismissed.

2.In the light of the aforesaid decision of the Division Bench as well as the Hon'ble Supreme Court, no further adjudication is required in this appeal. Accordingly, the present Writ Appeal is dismissed.

No costs.

Consequently, connected miscellaneous petition is closed."

4.In view of the consistent orders passed by the Writ Court as has been affirmed by the Division Bench of this Court and in one case the SLP also has been dismissed and the same became 3/5

final, we are not inclined to interfere with the said order of the Writ Court.

5.Resultantly, this Writ Appeal stands dismissed. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
