PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the respondents not to harass the petitioners under the guise of enquiry based upon the complaints given by the 6th respondent dated 10.10.2022 and 05.01.2023.
For Petitioners :Mr.Sasidharan Tamilkani S T For R1 to R5 :Mr.SS.Madhavan Government Advocate (crl.side) O RDER This Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure seeking for a direction to the respondent police not to harass the petitioners basing on a complaint given by the respondent No.6. 2/6
2.It is submitted by the learned counsel for the petitioners that there are matrimonial disputes between the petitioner No.1 and the respondent No.6. The respondent No.6 being the wife of the petitioner No.1 has filed a complaint earlier before the Thanjavur police and after enquiry by the All Woman Police Station, the said complaint was closed and another complaint was filed before the respondent No.2 police, basing on which the respondent police are harassing the petitioners.
3.The learned Government Advocate (Crl.side) submits that after closure of the earlier complaint, the respondent No.6 has given a fresh complaint and the same is registered as CSR.No.51 of 2023 and though the enquiry is being initiated, the petitioners are not cooperating, thereby the same is still pending. 4.Considering the circumstances made by the learned counsel on either side and on perusal of the records, this Petition is disposed of directing the petitioners to appear for enquiry before the respondent police and on such appearance, the respondent police are directed to complete the enquiry in CSR.No.51 of 2023 as 3/6
expeditiously as possible, not later than two weeks from the date of receipt of a copy of this order.
