PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the third and fourth respondents to approve the proposal of seventh respondent dated 31.01.2017 promoting the petitioner as laboratory Assistant on the strength of G.O.M.S.No.528 dated 18.05.1985 and GO.Ms No.110, dated 17.09.1985 and based on his earlier representation, dated 15.03.2017 and final representation, dated 08.08.2017 according to law.

ORDER

This Writ Petition is filed seeking a direction to the third and fourth respondents to approve the proposal of the seventh respondent dated 31.01.2017 promoting the petitioner as laboratory Assistant on the strength of G.O.M.S.No.528 dated 18.05.1985 and GO.Ms No.110, dated 17.09.1985 and based on his earlier representation, dated 15.03.2017 and final representation, dated 08.08.2017 according to law.

2. When the matter is taken up for hearing, the learned Government Advocate appearing for the respondents 1 to 4, on instructions submitted that subsequent to the filing of the Writ Petition, an order came to be passed on 01.03.2017 by negating the claim of the petitioner.

3. In view of the above submission, the learned Counsel appearing for the petitioner seeks liberty to the petitioner to challenge the said order dated 01.03.2017, in the manner known to law.

4. Granting such liberty, the Writ Petition stands closed. No costs.
