Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus, calling for the entire records relating to the common recruitment for the post of Grade II Police Constables (Men, Women, Third Gender), Gr II Jail Warders (Men, Women), and Firemen for the year-2017, C.No.R2/150/2017 dated 05.08.2017 in respect of the petitioner under Enrolment No.2411953 is concern and quash the same and consequently direct the respondents to conduct the retest on the petitioner for long jump and if the petitioner emerged as successful then allow petitioner to participate in all the subsequent selection process in the above said recruitment process.

By the consent of both sides, the writ petition itself is taken up for final disposal.

2.The petitioner was found disqualified in the long jump event. Having been aggrieved by the disqualification slip dated 05.08.2017, he has come to this Court seeking a direction to the respondents to re-conduct the long jump event. https://hcservices.ecourts.gov.in/hcservices/

3.The learned counsel appearing for the petitioner would submit that the respondents have given two chances to prove his efficiency in long jump. In the first chance, he has jumped to the distance of 3.51 meters. But this has been wrongly measured by the respondents. However, he was given second chance. In the 2nd chance, the petitioner was found foul play. As a result, he has been found disqualified. Therefore, a direction may be given to the respondents to re-conduct the long jump event. 4.But, this Court is unable to find any merit in the writ petition. Paragraph No.4 of the affidavit filed in support of this writ petition clearly shows that when the petitioner took part in the long jump event, in the first chance, he was able to jump a distance of 3.51 meters as against 3.80 meters. Therefore, he was given second chance.

Unfortunately, he was not able to utilise the 2nd chance also and was found foul. Therefore, I do not find any error in the impugned order and had the respondents found him fit by crossing the distance of 3.80 meters, he would not have been given a second chance. That itself shows that he was not able to pass the long jump.

5.Accordingly, this writ petition fails and the same is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
