This petition is filed to return Ex.B8, the original settlement deed dated 24.11.1998 standing in the petitioner's name marked in O.S.No.309 of 2007 on the file of the I Additional Sub Court, Madurai.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondents.

3. The learned counsel for the respondents submits that when the document pertains to the suit property, pending the second appeal, it cannot be released.

4. The learned counsel for the petitioner submits that he is ready to argue the second appeal itself, and he is not pressing the present petition and prays to fix the date for an early hearing in the second appeal itself.

5. Recording the said submission, this civil miscellaneous petition is dismissed as not pressed.
