PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the 5th respondent to consider the petitioner's representation dated 29.06.2022 and permit to conduct the temple festival of Arulmigu Shree Bhaavathi 1/5

Amman and Kaliyamman Temple, Silvarpatti Village, Pattathnaankkanpatti, Dindigul District on 12.07.2022 to 14.07.2022 and provide police protection for the peaceful conduct of the festival insofar as the petitioner is concerned.

This writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus to direct the 5th respondent to consider the petitioner's representation dated 29.06.2022 and to grant permission and provide police protection to conduct the temple festival of Arulmigu Shree Bhaavathi Amman and Kaliyamman Temple, Silvarpatti Village, Pattathnaankkanpatti, Dindigul District on 12.07.2022 to 14.07.2022. 2.The learned Government Advocate (Crl.side) appearing for the respondent police submitted that there are two groups in the village namely Silvarpatti and the suit is filed in O.S.No.54 of 2020 with a prayer of declaration and injunction with regard to status of Poosari and the same is pending. If the programme is permitted, there will be a 2/5

serious communal problem and law and order problem would also arise. Hence, he pleaded to dismiss the said petition.

3. I have considered the submission of the learned counsel appearing for the petitioner and the learned Government Advocate (criminal side) appearing for the respondents police.

4. The respondent police assessed the situation and represented that there are two groups in the village namely Silvarpatti and if the temple festival is permitted, law and problem would arise. To avoid that, he objected to grant permission to conduct the programme. In view of the above, this Court finds no merits in this petition. 5.Accordingly, this Criminal Original Petition stands dismissed. 08.07.2022 Index : Yes / No Internet : Yes/ No vsd 3/5
