Aggrieved over the long pendency of I.A.No.122 of 2020 in O.S.No.3 of 2017 on the file of Sub Court, Tiruchendur, the petitioner has approached this Court for early disposal of above said Interim Application.
2. Heard the learned counsel appearing for the petitioner. Since the case is for a limited relief of early disposal, no notice need be sent to the respondent.
3. On perusal of the affidavit, it is seen that the above said Interim Application is pending for more than two years. This Court, in earlier instance in C.R.P(MD).No. 316 of 2020, by its order dated 20.02.2020, has directed the trial Court to dispose of the Interim Applications within a month, but, the matter is still pending.
4. The learned counsel appearing for the petitioner would submit that the respondent / defendant is going to retire from service. Unless the Interim Application is disposed of he will not in a position to attach the amount in salary.
5. Considering the facts and circumstances of the case, without going into the merits of the case, this Court directs the https://hcservices.ecourts.gov.in/hcservices/ 1/2
C.R.P(MD).No.780 of 2020 learned Subordinate Judge, Tiruchendur, to dispose of I.A.Nos. 122 to 124 of 2020 in O.S.No.3 of 2017, pending on its file, on merits and in accordance with law, within a period of one month from the date of receipt of a copy of this order. Thereafter, the Trial Court is also directed to dispose of the Suit in O.S.No.3 of 2017 as expeditiously as possible.
6. With the above direction, this Civil Revision Petition is disposed of. No costs.
