ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 379 of IPC r/w Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.59 of 2021, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner and other accused had illegally transported one and half units of river sand by using tractor. Therefore, the present case came to be registered. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has nothing to do with the alleged occurrence.

CRL OP(MD)No.11281 of 2021 4.The learned Government Advocate(Crl.side) appearing for the respondent police submitted that the petitioner, without any valid permit, transported one and half units of river sand. He further submitted that the petitioner has three previous cases, in which, two cases were registered under Section 302 IPC. 5.Considering the nature of allegations levelled against the petitioner and also the fact that the petitioner has three previous cases, in which, two cases were registered under Section 302 IPC, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
