PRAYER:
To release the petitioners/accused interim bail for 7 days for attending his mother funeral ceremony, in the case in CC.No.459/2023 pending on the file of the Principal Sessions Court for EC and NDPS Act cases, Madurai in Crime No.413/2021 on the file of the respondent police for the alleged offences punishable under section 8(c), 20(b)(ii)(c), 25 and 29(1) of NDPS Act and 25(1B) (b) of Arms Act. ORDER : The Court Made the following order :- The petitioner, who is an accused in C.C.No.459 of 2023 pending on the file of 1/4
the Principal Sessions Court, for EC and NDPS Act Cases, Madurai, has filed this petition seeking bail. The said case was registered for the offences under Sections 8(c) and 20(b)(ii)(c), 25 and 29(1) of the Narcotic Drugs and Psychotropic Substances Act, 1985 and Section 25(1B)(b) of the Arms Act in Crime No.413 of 2021, on the file of the respondent police.
2.The learned counsel for the petitioner submits that the petitioner has moved this petition for interim bail to attend his mother's funeral that his mother died today ie., 14.06.2024 at 02.00 pm. He has also produced the death certificate of his mother issued by the Village Administrative Officer to that effect. 3.This Court directed the learned Additional Public Prosecutor to ascertain whether the above said fact is true or not.
4.The learned Additional Public Prosecutor, on verification, submits that the averment stated by the petitioner that his mother died on 14.06.2024 is correct and the cremation is likely to take place on 15.06.2024. 5.Considering the fact that the final rites of the petitioner's mother is to be held on 15.06.2024, this Court is inclined to grant Interim Bail to the petitioner with certain conditions.
6.Accordingly, the petitioner/accused, namely Ravi kumar @ Thavalai Ravi in Crime No.413 of 2021, is hereby directed to be released on interim Bail for a period of 2/4
two days till 17.06.2024, on executing a bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties each for a like sum to the satisfaction of the Superintendent of Prison, Central Prison, Madurai and, i)the Superintendent of Prison, Central Prison, Madurai on receipt of such sureties to his satisfaction, shall release the petitioner forthwith, along with two escorts, ii)the expenditure for the escorts shall be borne by the petitioner, iii)the petitioner is directed to surrender before the Central Prison, Madurai on 17.06.2024, at 11.00 am., without fail, iv)the learned Additional Public Prosecutor is also permitted to intimate the orders to the concerned Jail Authorities.
