Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of certiorarified mandamus, to call for the records in connection with the impugned seniority list published by the 1st respondent on 14.06.2024 and the consequential impugned order of rejection

passed by the 3rd respondent in his official website in proceedings nil dated nil and quash the both and consequently direct the respondents to follow spouse category priority as envisaged in G.O.(Ms).No.176, School Education (SE5(1)) Department dated 17.12.2021 and thereby consider the case of the petitioner for allotment in Kumbam Block under spouse category. For Petitioner :

ORDER

The instant Writ Petition has been filed by a Block Education Resource Teacher, challenging the seniority list published by the first respondent on 14.06.2024, and the consequential order of rejection passed by the third respondent. The petitioner has further prayed for a direction to the authorities to follow spouse category priority, as contemplated under G.O. (Ms).No.176, School Education (SE5(1)) Department, dated 17.12.2021, and consider her name for allotment in Kumbam Block under spouse category.

2. At the time of admission, a direction was issued by this Court to keep one post vacant in Kumbam Block under spouse category.

3. Learned Additional Advocate General, appearing for the respondents, pointed out that without prejudice to his contentions with regard to the merits of the writ petition, the petitioner could be accommodated at Myladumparai Block in Theni District in case the petitioner submits an application by accepting the said vacancy.

4. In view of the above said facts, the writ petitioner is hereby directed to submit an application to the respondents by accepting the said vacancy and, on receipt of the said application, the respondent authorities are directed to post the petitioner in the said vacancy.

5. With the above said observation, this Writ Petition stands disposed of. No costs. Consequently, the connected W.M.P.(MD) No.11573 of 2024 is closed.
