ORDER : The Court made the following order :- This Criminal Original Petition has been filed by the petitioner on 06.05.2025 under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying to grant an order of bail.
2. The petitioner / Accused (Sole) was arrested and remanded to judicial custody on 06.01.2025 for the offences punishable under Section 296(b) and 109 of BNS r/w Section 4 of TNPHW Act in Crime No.4 of 2025 on the file of the respondent-Police.
3. The case of the prosecution is that the petitioner is the husband of the defacto complainant's daughter. The petitioner suspects his wife's character, hence, she separated from him and is currently residing in the defacto complainant's house. On 06.01.2025, at around 10.45 hours, while the defacto complainant's daughter was sitting near the house, the petitioner allegedly came there, abused her in filthy language, attacked with knife and caused stab injuries as well as he caused cut injuries around the neck of the complainant's daughter, who is the wife of the petitioner. The victim was admitted in the hospital on 06.01.2025 and discharged on 21.01.2025.

Mr.J.Senthil Kumar, learned counsel appearing for the petitioner, submits that the petitioner has nothing to do with the alleged offence, and that a false case has been foisted against the petitioner. He however submits that the petitioner is ready to abide by any conditions to be imposed by this Court and co-operate with the investigation proceedings. He further submits that the petitioner has been in incarceration since 06.01.2025. Therefore, he prays for granting bail to the petitioner.

Per contra, Mr.S.S.Manoj, learned Government Advocate (Criminal Side) appearing for the respondent-Police, submits that the petitioner herein harassed the defacto complainant's daughter and attempted to kill her. He further submits that the victim was admitted in the hospital on 06.01.2025 and she was discharged from the hospital on 21.01.2025. He further submits that if bail is granted to the petitioner, he will cause threat to the defacto complainant and his daughter. Accordingly, he prays to dismiss this petition.
6. Heard on both sides. This Court has perused the records.

Considering the nature of the offence alleged by the petitioner and taking note of the grievous nature of injury allegedly caused by the petitioner to the victim and considering the period of treatment taken by the victim, if bail is granted to the petitioner, he may cause threat to the defacto complainant and the victim. Therefore, this Court is not inclined to grant bail to the petitioner. 3/4
