PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of mandamus directing the respondents 1 to 5 to follow the seniority / waiting list 2019 - 2020 prepared in the cadre of P.G.Assistant Teachers (English) by the 5th respondent so as to fill up the vacancies being arisen for the said post and in the light of the representation being sent in the form of legal notice dated 20.05.2023.

This writ petition has been filed seeking a writ of mandamus directing the respondents 1 to 5 to follow the seniority / waiting list 2019 - 2020 prepared in the cadre of P.G.Assistant (English) by the fifth respondent so as to fill up the vacancies being arisen for the said post and in the light of the representation being sent in the form of legal notice dated 20.05.2023.

2. Today, when the matter is taken up for consideration, learned counsel for the petitioner submitted that during the pendency of this writ

petition, certain developments have been taken place resulting in the petitioner filing another writ petition in W.P.(MD) No.15205 of 2023, wherein the appointment of the fifth respondent herein as P.G.Assistant was set aside and the said writ petition was partly allowed. There against, the petitioner herein as well as the fifth respondent herein have filed W.A.(MD) Nos.1320 of 2023 and 1441 of 2023 respectively and they are pending consideration.

3. In the light of the above, the relief sought for in this writ petition has become infructuous.

4. Accordingly, this writ petition is closed as having become infructuous. However, it is made clear that the grounds raised in the present writ petition are left open to be agitated in the appropriate proceedings by petitioner as well as the fifth respondent. No costs. Consequently, connected miscellaneous petition is closed.
