ORDER

Heard both sides.

2.The impugned order is set aside on the ground that the petitioner was not put on notice. The matter is remitted to the file of the first respondent to pass order afresh. The parties will appear before the first respondent on 05.02.2024 at 03.00 pm. I must place on record the submission of the learned Special Government Pleader that the original assignment order was passed by an authority who was not competent to do so. According to the learned Special Government Pleader, the petition mentioned lands are not natham lands. 3.I do not want to go into the merits of the mater. The first respondent will hear the petitioner as well as the private respondents and other interested persons, if any and pass final order on merits and in accordance with law within a period of three months thereafter.

4.This writ petition is allowed on these terms. No costs. Consequently, connected miscellaneous petition is closed.
