PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records in pursuant to the impugned order in Na.Ka.No. 20/Kaa/Aa/Thiruppu/2022 dated 27.06.2022 passed by the second respondent and quash the same as illegal consequently directing the respondents to grant permission and to provide police protection to conduct 'Kabadi' tournament on 09.07.2022 at about 5.00 p.m. to 10.07.2022 at about 9.00 p.m. at playground in Muniyandipuram, Konthagai Village, Sivagangai District on the basis of the petitioner's representation, dated 18.06.2022.

ORDER

This writ petitioner filed this Writ Petition seeking for issuance of a Writ of Certiorarified Mandamus to call for the records in pursuant to the impugned order in Na.Ka.No.20/Kaa/Aa/Thiruppu/2022 dated 27.06.2022 passed by the second respondent and quash the same as illegal, consequently directing the respondents to grant permission and to provide police protection to conduct 'Kabadi' tournament on 09.07.2022 at about 5.00 p.m. to 10.07.2022 at about 9.00 p.m. at playground in Muniyandipuram, Konthagai Village, Sivagangai District on the basis of the petitioner's representation, dated 18.06.2022. 2.The learned counsel appearing for the petitioner submitted that the petitioner gave a representation to the respondent police to grant permission for conducting 'Kabadi' programme on 09.07.2022 and 10.07.2022, which was rejected by the second respondent on the ground that there are communal problem between the parties. this petition to quash the proceedings and seeks permission to conduct the programme.

3.The learned Government Advocate (Crl.side) appearing for the respondent police submitted that there are two communities in the village namely Konthagai, wherein frequently, communal clashes happens between the parties. If the programme is permitted, there will be a serious communal problem and law and order problem would also arise. Hence, he pleaded to dismiss the said petition.

4. I have considered the matter in the light of the submissions made by the parties.

The respondent police assessed the situation and represented that there are two communities in the village namely Konthagai, wherein frequently, communal clashes happens between them and if the Kabadi tournament is permitted, law and problem would arise. To avoid that, he objected to grant permission to conduct the programme. In view of the above, this Court finds no merits in this petition. 3 / 4
