ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No.157 of 2024, for the offence under Section 380 IPC, has filed this petition seeking anticipatory bail. 1/4
2. The allegation against the petitioner is that she has helped the other accused to sell the stolen articles.
3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution. However, based on the confession statement of the co-accused, she has been implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) submits that the stolen articles have been recovered from the accused persons. He further submits that the petitioner is not having any previous case and the co-accused, who were arrested, have been released on bail.
5. Considering the nature of offence and also considering the fact that the petitioner is not having any previous case and the co-accused have been released on bail, this Court is inclined to grant anticipatory bail to the petitioner.
6. Accordingly, this Criminal Original Petition is ordered and the petitioner is ordered to be released on bail in the event of arrest or on her appearance within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate on condition that (i) the petitioner executes a bond for a sum of Rs.25,000/-(Rupees Twenty Five 2/4
Thousand) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Srivilliputtur.
(ii) The petitioner and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the government in proof of their residence address;
(iii) The petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders. She has to co-operate for the investigation. (iv) The petitioner shall not misuse the liberty granted to her by indulging in any further offence and shall not tamper with the prosecution witnesses.
