PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari calling for records in impugned order in T.R.No. 2025/0103/13/372810TR dated 28.04.2025 on the file of the 2nd respondent and quash the same as illegal.

ORDER

An order dated 28.04.2025 of the Zonal Deputy Tashildar mutating the patta solely in the name of Arulmighu Muthalamman Thirukovil is challenged in this writ petition primarily on the ground that such order was issued without providing a reasonable opportunity to the petitioner. 2.Learned Special Government Pleader submits that an inquiry notice was issued by the Revenue Divisional Officer in January 2025. He submits that a reasonable opportunity would be provided to the petitioner and others concerned before a speaking order is issued by the Revenue Divisional Officer. 3.The order impugned herein was issued without notice to the petitioner. As a consequence, the patta has been mutated by removing the names of several persons, including the petitioner therefrom. Since the order was issued without issuing notice to the petitioner and providing a reasonable opportunity, such order cannot be sustained and is hereby set aside. 4.It is, however, made clear that this order will not stand in the way of proceedings initiated by the Revenue Divisional Officer in relation to the 2/4
