O R D E R

[Order of the Court was made by M.DHANDAPANI, J.] The petitioner has filed this habeas corpus petition seeking a direction to the respondents to secure her son, namely, Tamilarasan, aged about 26 years, produce him before this Court and set him at liberty.

2. According to the petitioner, she got married with Meiyappan and got two children, namely, Rajeswari and Tamilarasan. Her husband Meiyappan was working as a Sanitary Worker in Nagapattinam Municipality and he died on 22.04.2017. Her daughter, namely, Rajeswari got married and she is living in Paravakottai with her husband. Her son, namely, Tamilarasan is working as an Office Assistant in Thuvakudi Municipality, Trichy District. In such circumstances, on 19.01.2025, he left the home for work, but he did not return to home. Though the petitioner searched for her son, she could not trace him. Therefore, she lodged a complaint on 23.01.2025 before the second respondent - Police and based on the said complaint, the second respondent

registered a case in crime No.48 of 2025 under the caption "Man Missing" on 12.02.2025. However, no fruitful steps were taken by the second respondent thereafter. Hence, she submitted representations before the first respondent on 08.04.2025 and 05.05.2025 seeking direction to the second respondent to trace her son. However, the first respondent has not considered the petitioner's representations. Hence, the present habeas corpus petition.

3. Learned counsel for the petitioner submitted that it would suffice if a direction is issued to the respondent - Police to complete the investigation in this case in accordance with law and trace the detenu within a time stipulated by this Court.

4. Learned Additional Public Prosecutor appearing for the respondent - Police, on instructions, submitted that based on the complaint given by the petitioner, the respondent - Police have registered a case in crime No.48 of 2025 under the caption "Man Missing" on 12.02.2025. Further, he submitted that investigation is going on and as and when the whereabouts of the detenu is found, he would be produced before the jurisdictional Magistrate Court and it would be intimated to the petitioner.

5. In view of the above, this habeas corpus petition is disposed of with a direction to the respondent - Police to complete the investigation in this case in accordance with law and trace the detenu as expeditiously as possible preferably within a period of eight weeks from the date of receipt of a copy of this order. As and when the detenu is secured or his whereabouts is identified, he shall be produced before the jurisdictional Magistrate Court and the same shall be intimated to the petitioner forthwith.
