Heard the learned counsel on either side.

2. The petitioner wants to go on voluntary retirement. The petitioner's grievance is that no order has been passed on his request. The learned counsel appearing for the petitioner would contend that if no negative order is passed within 90 days from the date of submitting the application, voluntary retirement is deemed to have been accepted. 2/4

3. Leaving open all the contentions of the petitioner, the second respondent is directed to pass order on the petitioner's application for voluntary retirement within a period of three weeks from the date of receipt of a copy of this order.
