O R D E R

This petition is filed seeking a direction not to harasss the petitioner, on the basis of the complaint given by the third respondent herein.

2.When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that based upon the complaint given by the third respondent herein, enquiry was undertaken in CSR No.593 of 2021 and during the course of enquiry, it was found that the petitioner and the third respondent are the husband and wife and they were living separately for more than five years and regarding the custody of the children, the dispute arose. The third respondent has given a statement to the effect that they will work out their remedy through civil Court. Similarly, the petitioner also gave a statement, based upon which, it was closed on 12.08.2021.

Crl.O.P.(MD)No.11330 of 2021 3.Since the enquiry has been closed, nothing survives for further consideration or direction in this petition. This Petition became infructuous and accordingly this Criminal Original Petition is dismissed as infructuous.
