The petitioner/Accused No.4, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 61(2), 308(2), 318(4), 351(2) of BNS, 2023 and Section 4 of TNPHW Act, in Crime No.186 2025, seek anticipatory bail.
2. The case of the prosecution is that the petitioner along with the other accused persons, started threatening the defacto complainant, who is a Junior Assistant at the Sericulture Department, by various modes, including sending multiple RTI petitions against her, since she used to assist her father in temple activities. Hence, the complaint.
3. The learned counsel appearing for the petitioner submits that false case has been registered against the petitioner and he has not involved in any criminal activities and demanded any money. Hence, she prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent Police submits that there are totally 5 accused persons in this case. Accused Nos.1 and 5 were arrested and in custody and Accused No.1 also detained under Act 14 of 1982. He further submits that other accused persons are absconding and the petitioner is also actively involved in the offence, having received Rs.10,000/- from the defacto complainant and he is having two previous cases. 2/3
5. Considering the bad antecedent and the fact that the other accused persons are also absconding and investigation is not completed, I am not inclined to grant anticipatory bail to the petitioner.
