Respondent/Plaintiff Prayer :- This First Appeal filed under section 96 C.P.C.,to set aside the Judgment and decree dated 04.02.2020 passed in O.S.No.118 of 2016 on the file of Additional District Court (Fast Track Court), Palani.

Decree:- This Appeal Suit coming on for hearing on this day, upon perusing the Grounds of the Appeal, the Judgment and Decree of the Lower court and the material records in this case and upon hearing the arguments of Mr.M.P.Senthil, Advocate for the Appellant and Mr.D.Venkatesh, Advocate, for Respondent, this court while Allowing the Second Appeal doth order and decree as follows;- i)That the Judgment and decree dated 04.02.2020 passed in O.S.No.118 of 2016 on the file of Additional District Court (Fast Track Court),Palani , be and hereby is set aside; ii)that the Appellant herein/Defendant be and hereby is directed to deposit a sum of Rs.3,00,000/-(Rupees Three lakhs only) to the credit of OS No.118 of 2016 on the file of the Additional District Court(Fast Track Court,)Palani within a period of three months. iii)that if the Appellant fails to do so, the appellant herein/Defendant will have to pay the same together with interest at the rate of 12% per annum thereafter;
