PRAYER :- For Bail in Crime No.95/2024 on the file of the respondent police. ORDER : The Court made the following order :- The respondent police registered a case as against this petitioner in Crime No.95 of 2024 for the offence under Sections 147, 148, 302 IPC, and remanded him 1/3

into judicial custody on 02.02.2024. Therefore, the petitioner has filed this petition seeking bail.

2. The case of the prosecution is that due to previous enmity, on 31.03.2024, the accused have attacked the defacto complainant's son using knife, beer bottle and also pelted stones at him. Due to which, the defacto complainant's son died. Hence the case.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. However, he has been arrested and he is languishing in jail from 02.02.2024. Therefore, he prays for grant of bail.

4. The learned Additional Public Prosecutor appearing for the respondent opposed for grant of bail on the ground that the accused have celebrated birthday party in a public road, when the same was questioned by the defacto complainant son, they tried to murder him. He further submits that the petitioner is having one previous case in his credit.

5. Considering the facts and circumstances of the case, the nature of offence and also considering the antecedent of the petitioner, this Court is not inclined to grant any relief to the petitioner.
