Constitution of India, praying this Court to issue a Writ of Certiorari, to call for the records pertaining to the impugned Sale Notice, dated 12.04.2023 No.S.No.04/39, issued by the 1st respondent herein and quash the same.
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S. KISHORE.C, Advocate for the petitioners and of Mr.R.SIVAKUMAR, Advocate for Respondents, the court made the following order:- (Order of the court was made by The Hon'ble Chief Justice) We have heard Mr.C.Kishore, learned counsel for the applicants and Mr.R.Sivakumar, learned counsel for the respondents - Bank.
2. Learned counsel for the applicants submits that because of the financial difficulties, the applicants could not comply with the order of this Court dated 17.05.2023. The applicants could not deposit 25% of the loan amount. In fact, the amount outstanding shown is Rs.17,32,923/- (Rupees Seventeen Lakhs Thirty Two Thousand Nine Hundred and Twenty Three only). Learned counsel submits that the applicants would deposit Rs.4,50,000/- (Rupees Four Lakhs Fifty Thousand only) within one week from today.
3. Considering the difficulties expressed, we extend the time granted by this Court under order dated 17.05.2023 by a period of one week from today.
4. List the matter on 28.06.2023.
