PRAYER: Civil Revision Petition is filed under Article 227 of Constitution of India, to direct the District Munsif Court, Madurai Town to dispose the E.P.No.18 of 2022 in RLTOP.No.1 of 2020 within a period stipulated by this Court.

ORDER

This petition has been filed to direct the District Munsif Court, Madurai Town, to dispose the E.P.No.18 of 2022 in RLTOP.No.1 of 2020 within a period stipulated by this Court.

2. The petitioner is the successful decree holder in RLTOP.No.1 of 2020, whereby, the respondent/tenant was directed to vacate the premises within a period to two months. Since the respondent failed to vacate the premises, the petitioner has filed E.P.No.18 of 2022. It appears 1/4

that aggrieved by the order passed in RLTOP.No.1 of 2020 dated 25.07.2022, the respondent filed an appeal together with an application to condone the delay in filing the appeal, which has been acknowledged by the Sub Court, Madurai, in RTA (Filing) No.817 of 2023. 3.Considering the above, this Court is inclined to dispose the Civil Revision Petition at the time of admission, by directing the Sub Court, Madurai, to dispose of the application filed for condone the delay in filing the appeal against the order dated 25.07.2022 in RLTOP.No.1 of 2020 within a period of 3 months from the date of receipt of a copy of this order. Thereafter, subject to the out come of the further proceedings of the Sub Court, Madurai, the Execution Court shall proceed further. 4.With the above direction, this Civil Revision Petition is disposed of. No costs.
