PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 323 and 307 I.P.C, in Crime No.444 of 2018 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that when the defacto complainant was riding his bike, the petitioner herein tried to collide with the defacto complainant using his Car. But the defacto complainant escaped and fell down on the road, due to which, he sustained injuries. Hence the complaint.
3. According to the petitioner, he is an innocent person and he has not committed any offence as alleged by the prosecution. 4.The learned Government Advocate [Criminal Side] appearing for the respondent submitted that the injured has been discharged from the hospital.
5.Considering the facts and circumstances of the case and also taking into consideration of the fact that the injured has been discharged from the hospital, this Court is inclined to grant Anticipatory Bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate Court No.V, https://hcservices.ecourts.gov.in/hcservices/
Tirunelveli, Tirunelveli District and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a likesum to the satisfaction of the learned Judicial Magistrate Court No.V, Tirunelveli, Tirunelveli District, concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30.am., until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
