Heard Mr.R.Alagumani, learned counsel for the petitioner and Mr.Veerakathiravan,learned Additional Advocate General, Assisted by N.Ramesh Arumugam, learned Government Advocate for the respondents.

The petitioner, who is aggrieved due to failure in giving appointment, despite he has been cleared the PET test, has filed this Writ Petition has been filed for issuance of Writ of Mandamus, seeking direction against the first and second respondents to issue the appointment order to the petitioner in Common Recruitment for the posts of Grade II Police Constables (Men, Women & Third Gender) Grade II 2/6
Jail Wardens (Men & Women) and Firemen, based on the communication dated 16.10.2017 in accordance with law.

Mr.R.Alagumani, learned counsel for the petitioner submitted that the petitioner has cleared all the examinations including the Physical Examination Test and only thereafter the certificate for having studied in Tamil medium has been sent to the Member Secretary, Tamil Nadu Uniform Services Recruitment Board for consideration. However, the candidates marks score card appeared through online reflected that he had got zero marks in PET and 55 marks in written test. The petitioner claims that he had cleared the PET examination and only then his certificate has been sent for verification in the year 2017. The petitioner got his score card on 14.08.2017 and he has sent representation in the year 2017 itself. Since the representation of the petitioner has not been considered so far, in continuation of the earlier communication made between the second respondent and the third respondent, an appropriate direction has to be given.

In fact, an earlier communication between the third and second respondents through letter in Na.Ka.No. A5/4615/2017 dated 20.09.2017 dated 29.05.2017, has clearly stated that the petitioner has met the physical examination fitness and thereafter the certificate verification has also been completed. In fact, he has been included in the qualified list of candidates in S.No.247 and the copy of the same has also been marked to the petitioner.

In view of the same, this Writ Petition is disposed of with a direction to the respondents to pass orders in the light of the earlier communication, where the petitioner is said to have been included in the selection list and the petitioner has to produce the required certificate. The said exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order. No costs. 21.06.2024 NCC:yes/no Index:yes/no Internet:yes/no Nsr 4/6
