ORDER : The Court Made the following order :- The petitioner is remanded to judicial custody in Crime No.848 of 2018 on the file of the respondent police for the offences punishable under Section 174 Cr.P.C. altered into 304(B) IPC and he seeks bail.
2. The petitioner/A2 is the mother-in-law of the deceased. A1 is the husband of the deceased. A3 is the sister-in-law of the deceased. The marriage between A2 and the deceased was solemnized in the year 2014. The case of the prosecution is that the petitioner/A2 along with other accused alleged to have harassed the deceased demanding dowry and hence the deceased committed suicide on 04.11.2018.
3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate [Criminal Side] for the respondent State.
4. According to the learned counsel for the petitioner, the Revenue Divisional Officer in his enquiry has concluded that there is no dowry harassment and the petitioner herein is innocent and she has been falsely implicated in this case. Further, the co-accused A3 in this case, who is the sister-in-law of the deceased has been released on bail by this Court on 18.12.2018 in Crl.O.P(MD) No.22310 https://hcservices.ecourts.gov.in/hcservices/
of 2018.
5. The learned Government Advocate [Criminal Side] opposed the grant of bail by stating that the investigation is not yet over.
6. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail subject to the following conditions:
(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate (Additional Mahila Court), Madurai and (ii) the petitioner shall appear before the respondent police daily at 10:30 a.m. until further orders.
