PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for a Writ of Certiorarified Mandamus, to call for the order of closure of his passport renewal application under reference File No.TR1075511766923 dated 26.06.2024 passed by the first respondent and set aside the same as erroneous and illegal and consequently direct the first respondent and consider the same again and issue the renewed passport bearing passport number J9116469 forthwith to the petitioner.

The petitioner challenges the proceedings of the respondent dated 26.06.2024, in and by which the petitioner's passport renewal application has been erroneously rejected, according to the petitioner.

2.The learned Standing Counsel for the first respondent would submit that the petitioner's passport application has been closed, after publishing due notice in the website in the second track status against the petitioner's File No.TR1075511766923. He further submits that the petitioner has an option to make a fresh application for re-issuance of passport by enclosing all the documents and by paying the requisite fees at the Passport Seva Kendra nearest to his residence.

3.Further, learned Government Advocate for the second respondent would submit that though there was a criminal case pending against the petitioner, the same has ended in acquittal and the police officials have no objection for re-issuance or renewal of Passport.

4.Considering the above, the petitioner is directed to make a fresh application for re-issuance of passport along with all requisite documentary evidence and necessary payment also being made for the same. On such application and payment being made within a period of two [2] weeks from the date of receipt of a copy of this order, the petitioner's passport application shall be taken up on 3/6

emergent basis, considering the fact that his earlier application was closed even as early as on 24.04.2024 and dispose of the same, within a period of six [6] weeks, thereafter. 5.Accordingly, the Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
